ORDER:

Petitioner states that he submitted an application for grant of pakka permit on theroad from Proddutur to Bangalore. It is stated that when the application was notconsidered he approached this Court by filing a writ petition and thereafter, theapplication was placed before the State Transport Authority at its meeting held on19.3.2005. It is represented that no orders have been communicated so far.

Petitioner contends that having regard to the need and urgency, he filed applicationfor grant of temporary permit on 19.12.2005 and complains that no action is takenthereon.

Heard the learned counsel for the petitioner and the learned Government Pleader forTransport.

By its very nature, an application for grant of pukka permit needs to be considered byState Transport Authority and it is likely to take quite some time. Obviously, toreduce the rigour on account of such delays, the Motor Vehicles Act and the Rulesmade thereunder provide for grant of temporary permits and such power is conferredupon the Secretary, State Transport Authority or the Regional Transport Authority, asthe case may be.

In the instant case, the application of the petitioner for grant of permit had alreadybeen dealt with by the State Transport Authority, but the result thereof is notcommunicated. In such an event, there should not be any difficulty for the Secretary,State Transport Authority in considering the application of the petitioner for grant oftemporary permit. The application cannot be kept pending indefinitely.

Hence, the writ petition is disposed of directing the respondent to dispose of theapplication of the petitioner within a period of two weeks from the date of receipt ofthis order. There shall be no order as to costs.
