ORDER:

The petitioner, who is accused No.1 in Crime No.241 of2014 of Maripeda Police Station, Warangal District, filed thepresent application under Section 438 Cr.P.C. seeking release inthe event of his arrest in connection with the above crimeregistered for the offences punishable under Sections 420, 466,468, 471 and 472 IPC.

The case of the prosecution is that the Head Master,ZPPSS, Chinnagudur, in charge of the Mandal Educational Officer,Maripeda Mandal, Warangal District, lodged a report stating thaton 24.11.2014 the petitioner and A.2, with a malafide intention tograb the funds of the Government, created false I.D. cards in thename of one A. Ramesh Kumar working as the Head Master,ZPPSS, Jayyaram school and A. Srinivas working as a SchoolAssistant in Jayyaram school. By producing the false I.D. cards, they tried to open unauthorized bank accounts in D.C.C.B.Maripeda Branch, in the name of two schools with a view towithdraw the funds. On coming to know about the same, theinformant went to the said bank and found that the accused forgedhis signature and also created false ID cards. Basing on theseallegations, the above crime came to be registered.

Heard the learned counsel for the petitioner and the learnedAdditional Public Prosecutor.

A perusal of the material placed before the Court wouldshow that the petitioner and A.2 created false I.D. cards and triedto open bank accounts in the name of two schools with a view tomisappropriate the funds of the Government which will betransferred to the two schools. The application filed by thepetitioner before the VI Additional Sessions Judge, Warangal atMahabubabad, seeking anticipatory bail was rejected by directingthe petitioner to surrender before the concerned Judicial FirstClass Magistrate and move an application for regular bail. Sincethe allegations made in the report prima facie constitute theoffences alleged and as the case is still under investigation, I amnot inclined to grant anticipatory bail to the petitioner.

Accordingly, the Criminal Petition is dismissed. However, the petitioner, if so advised, is directed to surrender before theappropriate Court and move an application for bail in theconcerned Court after giving prior notice to the Public Prosecutor,in which event, the same shall be dealt with on merits on the sameday or at least the next day, in accordance with law, uninfluencedby the observations made in the order.
