ORAL ORDER:
Heard both sides and with their consent, the writ petition is disposed of at the stageof admission.
It is the case of the petitioner that it obtained affiliation from the respondent universityto start B.Sc (Nursing) Course for the year 2004-05 for which selections werescheduled on 15[th] and 16[th] December 2004. It is further submitted that therespondent is competent to fill up 50% of the seats in total intake of the petitionerinstitution and the petitioner is entitled to fill up the remaining 50% seats, undermanagement quota.
It is further submitted that the respondent informed the petitioner college vide itsletter Ref.No.1536/B.Sc.,(Nursing)/EA5/2004, dated 21.12.2004, fixing the last dateas 27.12.2004 for admission under management quota, but classes shall becommenced from 13.12.2004 along with other candidates, and the list of candidatesadmitted under management quota shall be sent to the university by 29.12.2004along with fee and original certificates of the respective admitted candidates. But theabove information was communicated to the petitioner only on 27.12.2004.
It is the grievance of the petitioner that since the petitioner was not having affiliationto fill the seats under management quota by 13-12-2004, it could not commence theclasses and since it received the registration on 27-12-2004 only, petitioner is unable to submit the list of candidates under management quota to the respondenton or before 29-12-2004 and requested the respondent to extend time up to 30-1-2005, but no reply has been received. Hence this writ petition seeking a direction tothe respondent to extend the time for submitting the list of candidates admitted underManagement Quota along with the University Fee and Original Certificates till 30-1-2005.
However, having regard to the facts and circumstances averred in the writ petition, Iam of the opinion that since the petitioner had already made a request to therespondent to extend the time for submission of the list of candidates undermanagement quota, it is for the respondent-University to consider the request of thepetitioner. Therefore, I see no reason to interfere in the matter, and accordingly thewrit petition is liable to be dismissed.
In the result, the writ petition is dismissed. No costs.
