THE HON’BLE SRI JUSTICE R.SUBHASH REDDYandTHE HON’BLE SRI JUSTICE A.SHANKAR NARAYANACMA.No.1042of2013

ORDER:(per RSR, J)

This Civil Miscellaneous Appeal is filed underSection 37 of the Arbitration and Conciliation Act, 1996,against order, dated 16.12.2013 passed by the learned IIIAdditional Chief Judge, City Civil Court, Hyderabad, inO.P.No.2690 of 2013.

Heard learned counsel for the petitioner and also learned counsel, who appeared for the respondent.

From a perusal of the impugned order, it appears, itis only an ad interim order, in which, the trial Court issueddirections to the parties, to maintain status quo in respectof the petition schedule shares until further orders, whileposting the matter on 31.12.2013.

In that view of the matter, though the appellantseeks invalidation of the impugned order on severalgrounds, it is not necessary to go into the same at thisstage by this Court. As the impugned order is only an adinterim order and the case is listed for hearing tomorrow itself and as it is pleaded that the appellant is ready to filecounter before the trial Court, we are not inclined tointerfere with the impugned order at this stage. However,we deem it appropriate to issue directions to the learned IIIAdditional Chief Judge, City Civil Court, Hyderabad, todispose of the matter after filing counter and hearing theparties, as expeditiously as possible, preferably, within aperiod of four weeks from the date of receipt of a copy ofthis order.

The Civil Miscellaneous Appeal is disposed of with the directions as indicated above. No order as to costs.

Miscellaneous Petitions, if any pending in this CivilMiscellaneous Appeal shall stand closed.
