Against the possession nolice dared 11.1'1.2021, issued by [the]respondent under Section 13(4) of the Securitisation [and]Reconstruction of Financial Assets and Enforcement of [Security]Interest Act, 2002 (for short the SARFAESI Act), petitioners [have]filed Securitisation Application under Section 17 of the SARFAESI Actbefore the Debts Recovery Tribunal-Il, I{yderabad (for short 'theTribunal'), u.hich has been numbered as S.A.I.ll.No.1115 of 2021.

3. ln paragraph 7 of thc supporting afFrdavit, pctitioners have statedthat some persons claiming to be thc agents of respondent/Bank cameto thc properw of tl.rc pctitioners on 16.12.2021 ar.rd dcn'rarrdcd thepetitioners to vacate and hand over posscssion o[ the secured asset.Faced with the above threat, the present Wnt l)crition has been hled.4. Learned counsel for the pet-itioner submits that office ofPresiding Officer in the Tribunal is vacant and therefore, there is noregular functioning of the Tribunal.

Since the petitioner has already availed the statutory remedyunder Section 17 of the SARFAESI Act, rve are of the view- that itwould be just and proper if the peritioner pursues his remcdy before the'I'ribunal. Ilorvever, since the [-I'ribunal ]is not functional, rve direct that petitioner shall pay 15o/o of the outstanding dues to the respondentwithin a period of 30 days lrom todav.
