Present petition has been filed under Article 226 of theConstitution of India for directing respondents no.1 to 3 to protect the lifeand liberty of the petitioners from the hands of respondents no.4 to 6.
Learned counsel for the petitioners states that petitioner No.1is more than 20 years of age and petitioner No.2 is more than 21 years ofage and hence, petitioner No.2 is major and they want to solemnizemarriage against the wishes of respondents no.4 to 6 and have soughtprotection to their life and liberty. They apprehend danger fromrespondents no.4 to 6. The petitioners have submitted a representationdated 26.12.2022 (Annexure P-3) to respondent no.2.
Notice of motion to respondents no.1 to 3-State only.
On the asking of the Court, Mr. Vishnav Gandhi, DAG,Punjab accepts notice on behalf of the State.
Without entering upon an exercise to evaluate the evidentiary value of the documents placed on the file, I dispose of the petition with adirection to respondent no.2-Senior Superintendent of Police, Hoshiarpur, CRWP-12316-2022
Punjab to decide the representation (Annexure P-3) of the petitioners andgrant them protection, if any threat to their life and liberty is perceived. Itis Clarified that this order shall not be taken to grant immunity to thepetitioners from legal action for violation of law, if any, committed bythem. This order would not be understood having expressed any opinionwhatsoever by this Court on the validity of the relationship of thepetitioners. —
