ORDER:

Petitioner claims to be the owner of vehiclebearing No. AP 10 U 6678. The vehicle was seized on19-12-2012 by the Assistant Motor Vehicle Inspector(Enforcement), Nizamabad, the 2[nd] respondent herein, on theground that the petitioner did not produce the relevantdocuments viz., driving license, permit, tax proof, etc.

Heard the learned counsel for the petitioner and learnedGovernment Pleader for Transport.

It is not in dispute that several violations are allegedagainst the vehicle of the petitioner, when it was seized. Thequestion as to whether the allegations vis-à-vis the vehicle aretrue can be considered, as and when notice is issued by therespondents under the relevant provisions of law. Continueddetention of the vehicle would not subserve the purpose of therespondents. On the other hand, it would result in seriousdamage to the vehicle.

Hence, the writ petition is disposed of, directing therespondents to release the vehicle bearing No. AP 10 U 6678 tothe petitioner on deposit of Rs.10,000/- (Rupees ten thousandonly). Such release shall, however, be subject to theproceedings, that may be initiated vis-à-vis the vehicle and on furnishing an undertaking to the effect that the petitioner shallproduce the same, as and when required. There shall be noorder as to costs.

The miscellaneous petition filed in this writ petition alsoshall stand disposed of.
