CRIMINAL PETITION No.11044 OF 2009

This Criminal Petition under Section 482 Cr.P.C. is filed by the petitioners, accused Nos.1 to 4 respectively, seeking to quash theproceedings against them in Crime No.62 of 2009 of Balijipeta PoliceStation, Vizianagaram District, registered for the offences underSections 307, 326, 324 & 342 read with 34 IPC.

2. Heard.

3. The offences alleged against the petitioners are under Sections 307, 326, 324 & 342 read with 34 IPC and the victim has lostan eye in the incident.

4. Though there is delay in giving complaint, the reason for thesame appears to be that the victim was unconscious for 2 – 3 daysafter the incident.

5. In the circumstances, it is not a case, where it can be heldthat there is no prima facie case to quash the impugned proceedings. Hence, I see no grounds to entertain this petition.

6. Therefore, the Criminal Petition is dismissed at theadmission stage itself. The petitioners may approach the appropriateCourt for bail.
