ORDER:

This writ petition is filed for a writ of mandamus to declare theaction of the respondents in not considering the petitioners’ cases for theposts of Lower Division Clerk as illegal.

The petitioners are Ex-Casual Labour. They claimed absorptionagainst the posts of Lower Division Clerk in terms of B.P.Ms.No.36,dated 18.05.1997 and Memo No.OSD (P)/DM.I/A3/1138/85-1, dated26.08.1985.

In the counter-affidavit filed by the Assistant Secretary (Legal) ofrespondent No.1 Corporation, it is stated that in pursuance of the interimorder passed by this Court in Writ Petition No.33358 of 1997, thepetitioners were interviewed on 24.03.1998 along with other Ex-CasualLabour/Village Electricity Workers/Contract Labour and that as perB.P.Ms.No.36, dated 18.05.1997 and other relevant memos issued byAPSEB from time to time, the petitioners are eligible to be consideredonly for the posts of Junior Lineman. It is further stated that as 50%vacancies available for the Junior Lineman Cadre were already filled up,the petitioners could not be appointed and a detailed order was passedto that effect on 05.11.1998.

Neither a reply affidavit is filed controverting the avermentscontained in the counter-affidavit nor the learned counsel for thepetitioners is present to point out any illegality in order, dated05.11.1998 passed by the respondents.
