ORDER:
L.T.R.Case No.65/2009/ENK was instituted against thepetitioner before the Special Deputy Collector, respondent No.2herein, for eviction from Acs.2.06 guntas of land in SurveyNo.308/A, situated at Nacharam Village, Enkoor Mandal,Khammam District. The Case was allowed on 07.12.2009. Thepetitioner states that he has filed an appeal before theAdditional Agent to Government, respondent No.1 herein,together with an application for stay. His grievance is that noorders have been passed thereon and respondent No.3 is tryingto evict him.
Heard the learned counsel for the petitioner and thelearned Government Pleader for Social Welfare.
The petitioner has availed the remedy of appeal beforerespondent No.1 against the order of eviction. If he isdispossessed even while the application for stay is pending,nothing remains to be decided.
Hence, the writ petition is disposed of, directing that thepetitioner shall not be evicted till respondent No.1 passes theorder on the application for stay filed by the petitioner in theappeal against the order, dated 07.12.2009, passed inL.T.R.Case No.65/2009/ENK. There shall be no order as tocosts.
