HON’BLE SRI JUSTICE CHALLA KODANDA RAM

ORDER:

WRIT PETITION No.14375 OF 2009

The writ petition is filed by the petitioner through the A.P. StateLegal Services Authority, Hyderabad to direct the respondents torelease the exgrtia/bonus amount of Rs.27,280/- with interest @ 24%p.a from 1999.

Initially, the writ petition was listed on 20.07.2009 for admissionand thereafter the matter was adjourned on several times at therequest of the learned counsel for the respondents for gettinginstructions. Finally, the writ petition was admitted on 23.09.2009 andwhile admitting the writ petition, this Court passed an interim orderdated 23.09.2009 in W.P.M.P.No.18843 of 2009 which reads as under:

“In the circumstances, there shall be interim direction torelease the exgratia/bonus payable to the petitioner withina period of three months from today i.e., 23.09.2009.”

As can be seen from the main relief sought in the writ petitionand the relief which has been granted in W.P.M.P.No.18843 of 2009,the reliefs sought both in the main writ petition and as well as in theMiscellaneous Petition are one and the same. In other words, therelief sought by the petitioner itself was granted by way of interim orderand there remains nothing to be considered now.

It may be noted that in the counter-affidavit filed by the 1[st]respondent, it is categorically admitted that an amount of Rs.27,280/-was earmarked towards bonus/exgratia payable to the petitioner.

Having regard to the facts and circumstances of the case andespecially in view of the interim order passed by this Court inW.P.M.P.No.18843 of 2009, no further orders are required to bepassed in the writ petition.

Accordingly, the writ petition is closed. There shall be no orderas to costs. Miscellaneous Petitions, if any pending in this writ petitionshall stand dismissed.
