THE HON’BLE SRI JUSTICE T.SUNIL CHOWDARYCRIMINAL PETITION No.14070 of 2015ORDER:
This petition is filed under Section 482 Cr.P.C. seeking toquash the proceedings against the petitioners/accused Nos.4 and5 in C.C.No.85 of 2015 on the file of the Court of XX MetropolitanMagistrate, Cyberabad, at Malkajgiri.
At the time of arguments, learned counsel for the petitionershas sought permission of this Court to permit the petitioners towithdraw the criminal petition with liberty to avail all the remediesavailable to them under law including filing of a petition fordischarge. Learned counsel further submitted that the petitionersare facing much inconvenience to attend the trial Court on eachand every date of adjournment, hence, their presence before thetrial Court may be dispensed with.
Permission is granted.
Hence, the Criminal Petition is dismissed as withdrawn withliberty to the petitioners to avail all the remedies available to themunder law including filing of a petition for discharge, if charges arealready not framed.There is no dispute with regard to the identityof the petitioners/Accused Nos.4 and 5.Even if the presence ofthe petitioners/A4 and A5 is dispensed with, no prejudice would becaused to the second respondent.Hence, the presence of thepetitioners/A4 and A5 is dispensed with before the Court of XXMetropolitan Magistrate, Cyberabad, at Malkajgiri, on each andevery date of adjournment.However, they shall appear before thetrial Court as and when their presence is so required.
Consequently, Miscellaneous Petitions, if any, pending inthis Criminal Petition shall stand closed.
