ORDER:
Heard leamed counsel for the petitioner and learnedGovemment Pleader for Civil Supplies Department.
2. The petitioner is the owner of Mahindra Jeero X7_16 LightMotor Vehicle bearing registration No.TS 08 UG 0709 and tl.re sameis being used lbr transporlation of goods on hire basis. While so, onthe allegation that l5 quintals ol pDS rice was being illegallytransported by the petitioner in the vehicle in question, the stocks anclthe vehicle involved therein were seized by the 5'h respondent on08.12.2020 and a case in CrimeNo.141 of 2020 was regisrered underSection 420 read with 34 IpC and Section 7 of the EssentialCommodities Act against the petitioner.

Having considered the respective submissions made by thelearned counsel, inasmuch as enquiry under Section 6-,4. of theEssential Commodities Act and the criminar prosec,tion beibre thecriminal Court is yet to commence, pending enquiry of theproceedings, the petitioner is using the subject vehicle tir rtranspomation ol goods and in the light of the submission of thelearned counsel for the petitioner that there is no specification aboutthe PDS commodities either in the Essentiat commodities Act or inthe Control Orders, none can identify whether it is pDS rice or not and there is no rcstriction of movernent of paddy and rice and the veliiclewas used for transpoftation of the rice bags, the 5th respondent-StationHouse Officer, Bommala Ramaram P.S, RachakondaCommissionerate, shall release the subject vehicle on condition thepetitioner furnishing a Personal Bond for Rs.25,000/- (Rupees twentyflve thousand only) or third party security to the value of the [vehicle]and also on his furnishing an undertaking that he will [not ]alienate [or]change the physical features of the vehicle. The 5'r' respondcnt [shall]also wlitc to the R-fA authority not to transl'er the vehicle in [qucstion]on any thircl pafties narne without clearance lrom the Civil SuppliesDeparlnrent. The re lease of vehicle is in view [of, ]the situation [existing]on accourlt of COVID-.l9. The release of the seized [stock and vehicle]shall be subject to outcome of the [proceedings ][under ][Section ][7 ][of ][the]Essential Commodities Act.
4. Subject to the above, the writ [petition ][is ][disposed ][of. ][No]
costs. Miscellaneous petitions, if any [pending, shall ][stand closed.]
