ORDER:

The relief sought for in this Writ Petition is to declare the action ofthe respondents in not considering the petitioner’s representation dated31.10.2012 as arbitrary and illegal and to consequently direct therespondents to allot the house site pattas in favour of the petitioner. The petitioner submitted a representation requesting therespondents to issue patta certificate for the land, which she occupiedand raised a hut thereupon.

As the third respondent had demolished the structurehighhandedly, this Court directed his appearance. Thereafter the thirdrespondent has filed an affidavit stating that the structure, which he haddemolished earlier, has since been restored. Sri Chalakani VenkatYadav, learned Counsel for the petitioner, on instructions, states that thestructure has been restored.

As the respondents claim that the subject land is Governmentland, I consider it appropriate to dispose of the Writ Petition directing therespondents not to dispossess the petitioner from the subject land, except in accordance with law, including the provisions of the AndhraPradesh Land Encroachment Act, 1905. The petitioner’s application forallotment of house sites shall also be examined by the first respondent, and orders shall be passed thereupon, within three months from the dateof receipt of a copy of this order.

The Writ Petition is disposed of accordingly. The miscellaneouspetitions pending, if any, shall also stand disposed of. There shall be noorder as to costs.
