WRIT APPEAL No.1666 of 2014

Judgment:(per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta)

Sri K.S. Murthy, learned counsel, fairly submits that the Hon’bletrial Judge was not assisted properly by any of the parties to theproceedings. He therefore submits that the impugned order may not besustained.

Accordingly, we set aside this order. However, this order will notprevent and prejudice any of the parties from filing miscellaneousapplication with the fresh materials not relied on earlier by the parties.

The writ appeal is accordingly allowed.

Consequently, pending miscellaneous petitions, if any, shallalso stand closed. No costs.
