ORDER:
This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief "...to issue an order or any direction, [more ][particularly ][one]in the nahlre of Writ of Mandamus declaring [the ][action ][of]the respondents in not registering [FIR against ][the unoffrcial]respondents though the complaint dated 26.06.2023 [is]made by the petitioner against the unofficial [respondents for]illegal Trespass, Cheating, impersonation, [creates ][fake ][artd]forged documents and playing fraud [with ]a [malafide]intention for wrongful gain and threatening the [petitioner]with dire consequences, as arbitrary, illegal, discriminatoryand unconstitutional besides contrary to Section [154 ][of ][the]Criminal Procedurc Codc consequcntly [direct ][thc]respondents to register FIR against the [unofhcial]respondents by considering ttte representation/complaintdated 26.06.2023 made b the [petitioner ]herein [strictly, ][in]accordance with Section 154 of the Criminal [Procedure ][Code]and further direct the 4th respondent [not to ][dispossess the]petitioner from the subject property..."
Heard leatned counsel for the [petitioner, ][learned]
2. Assistant Government Pleader for [Home, ][appearing for ][respondent]Nos.1 to 4 and perused the record.
3. The petitioner is the absolute owner [and ][possessor ][of]
plot Nos.27 and 28, admeasuring 40O square [yards, forming part]of survey No.45l2 situated at [Green ][Avenue ][of ][Manikonda ][Jagir]Village, Rajendra Nagar, Ranga Reddy, [having purchased the ][same]by virtue of registered Sale Deed [vide Document No.8744 ][of ][1993,]dated 27.09.1993. The case of the [petitioner ][is ][that ][he ][entered]into a Development Agreement-cum-General [Power ][of ][Attorney]
with respondent No.7 to develop the subject property byconstructing a Multi-Storied Building. It is further case of thepetitioner that as per Article-Vll of the said DevelopmentAgreement, entire terrace rights will be devolved upon the owner'sshare after leaving access to lift room and water tank. Accordingly,the petitioner has constructed a room, toilet and kitchen for hispersonal use at terrace. It is further case of the petitioner thatrespondent No.5, claiming to be wife of respondent No.7, createdfake and forged rental agreement, dated 16.04.2023 withrespondent No.6 mentioning terrace as Flat No.502 on 5th floor ofsubject property and interfering with the petitioner's peacefulpossession and enjoyment over the said property, without any rightor title. It is further case of the petitioner that respondent No.6 incollusion with respondent No.5 is interfering with the property on26.06.2023 along with anti social elements and threatened thepetitioner with dire consequences in most abusive language.Stating said facts, the petitioner lodged a complaint, dated26.06.2023 before respondent No.4, but so far no action has beentaken on the said complaint.

The grievance of the petitioner is that though thecomplaint of the petitioner, dated 26.06.2023 discloses cognizableoffences, respondent No.4 is not initiating any action under Section 154 of Cr.P.C. and a-lso not [following ][the ][guidelines issued ][by ][the]Honble Apex Court in the [case ][of ][Lalitha ][Kumari ][v' ][State of]Uttar Pradesh [r.]
5. Learned Assistalt Government [Pleader ][for ][Home, ][on]instructions, would submit [that ][acting ][on ][the ][said ][complaint,]respondent No.4 conducted [preliminary enquiry and ][during ][the]course of enquiry, it is [revealed ][that ][there ][are ][civil ][disputes]between the petitioner [and ][the ][unofficial ][respondents ][and]accordingly, respondent [No.4 ][closed ][the ][said ][complaint, ][dated]26.06.2023,'as civil [in nature.']
6. In view of the said [submissions, ][the ][Writ ][Petition ][is]disposed of giving liberty [to ][the ][petitioner ][to ][question ][the ][said]closure report, if [he ][is ][so ][advised. Further, ][the ][respondent-police]are directed not to interfere [with ][the personal life and ][liberty ][of the]petitioner, in any manner, except [in ][accordance ][with ][law ][There]shall be no order as to [costs.]
Miscellaneous [petitions, ]if [any, ][pending ][in ][this ][writ ][petition]shall stand closed.
