Petitioners seek protection of their life and liberty as they apprehend danger at the hands of respondents No. 4 and 5 and other relatives because they have solemnised marriage on 29.12.2021 against the wishes of said respondents.
It is submitted that the both the petitioners are major, their dates of birth being 08.09.1999 and 05.03.1996, respectively. Adhar Cards of both the petitioners regarding their date of birth are appended with the petition as Annexures P-1 and P-2, respectively. Copy of marriage certificate of the marriage is on record as Annexures P-4. Learned counsel for the petitioners submits that respondents no.4 and 5 are against this marriage as petitioner no.2 is a divorcee. Reference is made to the decree of divorce dated 19.2.2021 (Annexure P-3) a certified copy thereof is attached with this petition. It is further submitted that there is no impediment to the marriage of the petitioners. Learned counsel for the petitioners identifies the petitioners on the basis of documents attached. Petitioners, it is stated, submitted representation dated 30.12.2021 (Annexure P-5) to respondent No.2 i.e., CRWP No. 12397 of 2021 (O&M) 2
Senior Superintendent of Police, Tarn Taran, for redressal of their grievance but no action has been taken thereon.
Notice of motion to respondents No.1 to 3.
Mr.Arun Kaundal, DAG., Punjab, accepts notice on behalf of respondents No.1 to 3. Advance copy of the petition stands served.
Without commenting upon the age of the petitioners or validity of their marriage or validity and genuineness of the certificates/documents appended with the petition, respondent No.2 –Senior Superintendent of Police, Tarn Taran, is directed to look into representation dated 30.12.2021, Annexure P-5 submitted by the petitioners and take appropriate action if any/as may be required, keeping in view the threat perception to the petitioners.
Petition is disposed of accordingly.
