THE HONOURABLE SRI JUSTICE N.R.L.NAGESWARA RAO
CRIMINAL PETITION No.13946 OF 2011
ORDER:-
In view of the fact that this petition is filed to quash theproceedings in Calendar Case No.1100 of 2011 on the file of the XAdditional Chief Metropolitan Magistrate, Secunderabad.
The police after investigation have filed charge sheet against allthe accused persons for serious offences under Sections 418, 420,406 read with 120-B of the Indian Penal Code and also Section 82 ofthe Registration Act, 1908, where LW.1, who is the complainant, issaid to have been cheated to a tune of Rs.24,00,000/- with regard tothe immovable property. The material collected by the InvestigatingOfficer as per the charge sheet clearly goes to show that there is primafacie material to proceed with the trial of the case. However, thepetitioners are at liberty to put-forth their contentions before framing ofthe charges. It is not the rarest of the rare cases where theproceedings are to be quashed.
Accordingly, the Criminal Petition is dismissed.
