ORDER:

The petitioner was selected as an untrained Teacher by theProject Officer, ITDA, West Godavari District, through proceedings, dated 21-12-2000. A condition was incorporated to the effect thathe shall obtain TTC/B.Ed. degree within the stipulated period as acondition precedent for being put in the regular scale. Thepetitioner states that he was enrolled himself for the Diploma inEducation (D.Ed.) course in the year 2007 and has passed in all thetheory papers. According to him, he did not appear in threepractical examinations, due to ill health and thereby his result wasnot declared. The petitioner was making representations to therespondents for conducting the practical examinations, so that hecan complete the course. Reference is also made to the lettersaddressed by the Principal, District Institute of Education andTraining (DIET), Bommuru, Rajahmundry – 3[r d ]respondent to theCommissioner & Director of School Education – 2[nd] respondent. His grievance is that no steps have been taken thereon.

2. Heard the learned Counsel for the petitioner and thelearned Government Pleader for School Education.

3. The appointment of the petitioner was to the post ofuntrained Teacher. Facility was accorded to such Teachers toacquire the D.Ed. Degree through distance mode. The petitionergot enrolled into that course and has also appeared in theexaminations. Though he cleared the theory examinations, he didnot appear in three practical examinations. Five years have elapsed since then. It is brought to the notice of this Court that thevery D.Ed. course through distance mode, is no more in vogue andit would not be possible to conduct practical examinations. Therefore, this Court cannot grant any relief. However, if theCommissioner creates any facility for the candidates, similarlysituated as the petitioner, to complete the course, the same shall beextended to the petitioner.

4. The Writ Petition is, accordingly, disposed of. Themiscellaneous petition filed in this writ petition shall also standdisposed of.
