HON'BLE SRI JUSTICE G. BHAVANI PRASAD

WRIT PETITION No.26533 OF 2007

ORDER:(Per Hon’ble Sri Justice A.Gopal Reddy)

This is a taken up writ petition on the basis of telegram sent bythe petitioner to the Hon’ble Chief Justice, dated 10.12.2007 allegingthat in the absence of the petitioner, his wife Smt. K.VenkataLakshumma has been forcibly taken away by the Lingala Police,Kadapa and since then she has been illegally confined.

Sub-Inspector of Police, Lingala Police Station-secondrespondent herein filed a counter affidavit stating that no case hasbeen registered or pending against the alleged detenu and she was never taken into custody. The Station House Officer-first respondentherein visited the house of the petitioner and alleged detenu, who arethe neighbours of one Ankireddy Bhaskar Reddy, an accused in CrimeNo.37 of 2007 and enquired his whereabouts. The said accused ismaternal uncle of the petitioner. Since the police are making efforts toapprehend said Ankireddy Bhaskar Reddy, during the course ofinvestigation, they visited the house of the petitioner and allegeddetenu to know his whereabouts and only to stall the investigation, theabove telegram appears to have been sent.

The statement of the alleged detenu recorded by the Tahsildar,Vemula Mandal, Kadapa District, which is filed along with the counteraffidavit, discloses that the police came to her house and enquiredwhereabouts of Ankireddy Bhaskar Reddy, who is the son of herhusband’s sister and due to fear, she left the house and since then shehas been staying with her parents’ house. She asserted that she wasnever arrested by the police.

The statement of the alleged detenu belies the allegation madein the telegram that she has been illegally detained by the police. Hence, the writ petition is dismissed. No costs.
