Dt.29.12.2005

Between:

K.Madhava Reddy … Petitioner

And

The District Collector, Anantapur, and

3 others. … Respondents

ORDER:

The petitioner questions the order of the Joint Collector, Anantapur, dt.16.9.2005 inallowing the appeal filed by the 4[th] respondent against the order of the RevenueDivisional Officer dt.7.3.2005 wherein the authorization of the 4[th] respondent hasbeen cancelled. Against which the 4[th] respondent filed an appeal and the appellateauthority allowed the appeal and accordingly the authorization of the fair price shopof the 4[th] respondent has been restored and he is distributing the essentialcommodities. As against the said order, the petitioner filed revision along with anapplication to suspend the order of the 2[nd] respondent before the District Collector -revisional authority.

Heard the learned counsel for the petitioner and the learned Government Pleader forthe respondents.

Having filed a revision before the first respondent, it is not open for the petitioner toquestion the said order of the Joint Collector before this Court. As the petitioner isnot entitled to pursue parallel proceedings, I do not see any justification on the partof the petitioner to file this writ petition.

The writ petition is accordingly dismissed. No costs.

However, the revisional authority may consider and dispose of the revision aftergiving reasonable opportunity to the petitioner as well as to the 4[th] respondent inaccordance with law.
