Conclusion
THE HON'BLE MR JUSTICE C.V.NAGARJUNA REDDY
Writ Petition No.33608 of 2010
DT.31.12.2010
Between:S.Shankar
And
… Petitioner
The Tahsildar, Pagidyala Mandal, Kurnool District and others … Respondents Counsel for the Petitioner:Sri V.R.Avula Counsel for respondents: AGP for Civil Supplies The Court made the following ORDER:
ORDER:
This writ petition is filed for a mandamus to set aside order, dated27.11.2010, served on the petitioner on 23.12.2010, whereby respondentNo.2 has suspended the petitioner’s authorization.
In the affidavit filed in support of the writ petition, the petitioner hasaverred that against the order impugned in this writ petition, he hasalready filed an appeal before respondent No.3 along with stayapplication and that his stay application is not being disposed of byrespondent No.3.
Inasmuch as the petitioner has already availed the remedy ofappeal to question the impugned order, I do not find any reason toentertain the writ petition at this stage. As the petitioner’s grievance is limited to non-disposal of his stay application, respondent No.3 isdirected to dispose of the same, if not already done, within a period ofone week from the date of receipt of a copy of this order andcommunicate the same to the petitioner.
Subject to the above direction, the writ petition is disposed of.
As a sequel to disposal of the writ petition, W.P.M.P.No.42597 of2010 filed by the petitioner for interim relief is disposed of as infructuous.
