HONOURABLE MRS. JUSTICE T.MEENA KUMARI&HONOURABLE MS JUSTICE G. ROHINI

WRIT PETITION No:27625 OF 2007

ORDER: (Per Hon’ble Smt. Justice T. Meena Kumari)

The present writ petition is filed by the petitioner seeking todeclare the action of the respondent in issuing property tax bill/demandnotice dated 14.8.2007 and 21.11.2007 in respect of House No.3-5-75,Kotla Shaikhan Street, Karimnagar District, for payment of allegedarrears of property tax in excess of property tax for one year, as illegaland arbitrary.

The main grievance of the petitioner is that the respondentissued property tax bill dated 14.8.2007 for current half yearly propertytax of Rs.453/- and arrears of Rs.17,479 and penalty as Rs.35,170/-. According to the petitioner, the arrears pertain to the period long beforeher purchase and hence, she submitted a representation, but therespondent has not taken any action. Hence, the present writ petitionis filed by the petitioner.

Heard the learned Counsel appearing for the petitioner and thelearned Counsel appearing for the respondent and perused thematerial available on record.

It is the contention of the learned Counsel for the petitioner thatthe petitioner has made a representation before the authorities and thesame is pending consideration.

The learned Counsel for the respondent also conceded thesame.

Having regard to the above facts and circumstances of the caseand in view of the fact that a representation made by the petitioner ispending consideration, without expressing any opinion on the merits ofthe case, We feel it just and proper to dispose of the writ petition with adirection to the respondent to dispose of the representation made by the petitioner, within a period of eight weeks from the date of receipt ofa copy of this order subject to the condition of the petitioner depositingone year tax, within a period of four weeks from today. It is made clearthat till the `disposal of the representation, the respondent is directednot to take any coercive steps.
