Writ Petition No.20531 of_2008
In this Writ Petition, the petitioner seeks declaration,by way of Mandamus, that the action of respondent Nos.1and 2 in not taking steps for demolition of the structuresraised by respondent No.3 in deviation to the sanctionedplan, by encroaching on the road towards the north--eastern side of House Nos.18-7-867/1 and 18-6-864,Outside Gowlipura, Hyderabad, in spite of hisrepresentations, is illegal and arbitrary.
At the stage of admission, this Court, vide interimorder, dated 19-09-2008, directed the second respondent to depute oneof his responsible Officers to verify whether anyconstructions are made by the third respondent byencroaching on the public street.
Today, when the Writ Petition is taken up for hearing,the Assistant City Planner, Circle No.4, Greater HyderabadMunicipal Corporation, filed a report stating that pursuant tothe said interim order, one Sri B.Vithal Rao, Section Officer, Ward No.18, GHMC, wasdeputed to inspect and report and on inspection, he foundthat the third respondent made encroachment of lane to an extent of 2 feet towards north-eastern side i.e., towards thehouse of the petitioner and that their Officials haveremoved the said encroachment.
In view of the steps taken by respondent Nos.1 and2, as indicated in report, dated 30-12-2009, the grievanceof the petitioner is redressed.
Placing on record the aforesaid report submitted bythe Assistant City Planner, Circle No.4 of GHMC, this WritPetition is closed. There shall be no order as to costs.
