THE HON’BLE SRI JUSTICE L.NARASIMHA REDDY
ORDER:
WRIT PETITIION No.17160 of 2008
The petitioners are the owners of the premises abutting aroad in Vikarabad Town known as “Ananthagiri-Alampally Road”. The respondents intended to widen the road. The proceedingsensued in relation thereto. Ultimately, notification under Section4(1) of the Land Acquisition Act, 1894 (for short ‘the Act’) wasissued on 13.11.2007. The grievance of the petitioners is that therespondents are not demarcating the land that is sought to beacquired.
Heard the learned counsel for the petitioners and thelearned counsel for the respondents.
The extents mentioned in the notification, under Section4(1) of the Act, are always tentative. It is only after a draftdeclaration under Section 6 of the Act is published that the exactextent that is needed for acquisition would be known.
During the pendency of the writ petition, the first respondentpublished draft declaration under Section 6 of the Act on26.11.2008. The extents that are needed for widening of the roadare mentioned in it. While in some cases, there is increase of theextents mentioned in the notification under Section 4(1) of the Act,in certain other cases, there is decrease. Now, that a final picturehas emerged. The respondents have to demarcate the acquiredland, so that necessary steps would be taken by the respectiveowners to protect their remaining property.
Hence, the writ petition is disposed of, directing that therespondents shall demarcate the acquired land as mentioned inthe declaration under Section 6 of the Act, within four (4) weeksfrom today. There shall be no order as to costs.
