ORDER:

This Writ Petition is filed questioning the proceedings No.A1/382/85 (ES.Com), dated 28-6-1989, issued by the second respondent, cancelling the contract given to the petitioner fortransportation of essential commodities from Kondapuram Mandal level stock point to theFair Price Shops.

The very award of contract was subject to condition of acquiring vehicle for suchtransportation by the petitioner. But in the order, it is stated, contrary to the terms andconditions of contract, the petitioner had engaged private vehicle for transportation of goods.

The petitioner having agreed with the terms and conditions for award of contract, he hadunable to comply the same. In that view of the matter, I do not find any illegality in the orderdated 28-6-1989 passed by the second respondent.

The Writ Petition is devoid of merits and the same is accordingly dismissed. No order as tocosts.
