ORDER:

This writ petition is filed seeking a Mandamus to declare the action of the 2[nd] respondent in notpassing the orders in appeal filed by the petitioneragainst the orders of the 3[rd] respondent videproceedings in Rc.No.E.824/2004 dated 20.5.2006as arbitrary and illegal.

It appears that the petitioner was a fair price shop dealer of Pinnapuram Village, PanyamMandal, Kurnool District. While so, hisauthorization was cancelled vide proceedings dated20.5.2006 the 3[rd]by respondent-RevenueDivisional Officer, Nandyal. Aggrieved by the same, the petitioner carried the matter in appeal before the2[nd] respondent-Joint Collector and the same is pending. According to the petitioner, though theappeal was filed as early as on 20.6.2006, the sameis not yet disposed of and the non-disposal ofappeal causes prejudice to his interest.

In view of the above, without expressing any opinion on merits, the 2[nd]respondent-JointCollector is directed to dispose of the appealpurported to have been filed by the petitioner on20.6.2006 aggrieved by the orders passed by the3[rd]respondent videhis proceedings inRc.No.824/2004 dated 20.5.2006, within a period oftwo months from the date of receipt of a copy of thisorder.

Writ petition is accordingly disposed of. Nocosts.
