Fleard Sri. D. Ramakrishna, [learned ][Counsel ][for ][the]

2. Fleard Sri. D. Ramakrishna, petitioner and perused [the ][record.]

i. f he pctitioner herein is the [petitioner ][No.l ][in ][the main ][OP]filed under Section l0-A of the Indian Divorce Act, [1869 ][(for ][short]'the Act, I1169') seeking dissolution of marriage by mutual consent.1.hc respondent herein is the petitioner No.2 (wife) in the main Op.4. It is thc case of the petitioner herein that on the matter beingpresented. tlre [(lor-rrt ]below had posted the same to 13.O2.2024 lorconciliation: and thus, the instant revision is preferred seeking roset-aside the docket order dated 09.08.2023 and to fix an earlv dareol' hcaling fbr tlic rnain OP.

5. I have taken note ofthe contentions urged

6. Admittedly the first hearing of the [case ][was ][fixed ][on]13.02.2024.It is also admitted [that ][no ][application ][was ][made ][to ][the]Court below seeking an advancement [of ][hearing.]

7. Though the petitioner [trerein ][contends ][that ][he ][had ][failed ][to]obtain a copy of the [docket ][order ][dated 09.08.2023 ][wherein ][the]matter was posted for [conciliation, ][it ][is not ][shown ][to ][this Court ][as]to how the same hinders [him from ][making ][an ][application ][for]advancement of hearing [and ][waiving the ][process ][of ][conciliation]before the Court [below.]

8. That apart no cogent [reason is ][put forth by ][the ][petitioner, for]this Court to exercise [its ][supewisory ][jurisdiction whilc ][bypassing]procedure established [under the Code ][ofCivil ][Procedure, ][1908 ][lor]advancement of hearing.

g. Further, except stating [that ][the ][main ][OP ][r'vas ][llled ][tbr ][divorcc]mutual [consent' ][no ][valid ][reason ][ior ][rvaiving ][the ][statutory]by cooling period [was ][forth ][coming' ][lt ][is ][to ][be ][seen ][that ][in ][most ][cases]lor divorce, [the ][parties ][would ][have ][undergone ][ce(ain ][period ][of]separation, [but ][however ][the ][same ][does ][not entitle thcln ][to ][seek]

waiver of the prescription under the Act, l g69 as a matter of right.

The Hon'ble supreme Court in Amir Kumar vs. suman Beniwart, held that the purpose behind introducing the statutory coolingperiod of 6 months was ro preserve the possibility of reconciliationhowever slight it was, and that the discretionary power vested inthe Court to condone such period ought to be exercised sparinglyand for compelling reasons.

10. Therefore, this Court is of the considered view that theinstant revision was pret-erred prematurely.

I l. Accordingll . thc Civil Revision petition is dismissed.
