THE HON’BLE SRI JUSTICE P.NAVEEN RAO

WRIT PETITION No.45976 OF 2016

ORDER :

Heard. With the consent of both the counsel, the Writ Petition is disposed of at the admission stage.

2. Petitioners claim to own small pieces of land in Sy.No.502, Yerrabalem Village, Mangalagiri mandal, Guntur District. With respect to the extent of ownership, petitioners have agreed under Land Pooling system floated by the Government under the Capital Regional Development Area. According to the petitioners, they have all converted the agricultural lands into house plots and therefore, their lands have to be treated as house plots while determining the amount payable or allocation of alternative lands, after the development, whereas, the authorities are treating their lands as agricultural lands. Petitioners have submitted their representations which were acknowledged by the competent authority on 01.12.2016, ventilating their grievance on this issue. Petitioners contend that the said representations are yet to be disposed of, this writ petition is filed.

3. Having regard to the fact that representations submitted by the petitioners are pending consideration, without expressing any opinion on merits, the Writ Petition is disposed of, directing the 3[rd]respondent-Deputy Collector, Capital Regional Development Authority (CRDA), to consider the representations of the petitioners and pass appropriate orders as warranted by law, and communicate the decision to the petitioners by a reasoned order, within a period of three (3) weeks, from the date of receipt of copy of this order. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
