ORDER:
The petitioner obtained B.A. degree from Vinayaka MissionsUniversity, Salem, Tamilnadu, through correspondence. Sheappeared in the ICET-2009, conducted by the Andhra University andobtained a rank of 175108. She has been admitted into I year of MCAcourse in Kakatiya College of Computer Science, the 2[nd] respondentherein.
The 2[nd] respondent submitted the list of selected candidates forapproval by the Registrar, Kakatiya University, the 1[st] respondentherein. Through proceedings, dated 06.12.2009, the 1[st] respondentdirected cancellation of admission of the petitioner, on the ground thatthe B.A. degree obtained by the petitioner from Vinayaka MissionsUniversity, Salem, is not equivalent to similar degree awarded by theKakatiya University, and the petitioner feels aggrieved by the same.
Heard learned counsel for the petitioner and learned StandingCounsel for the 1[st] respondent.
The qualification for admission into MCA course is, pass indegree course conducted by the universities in the State, or equivalentthereto. The petitioner did not obtain any degree from the universitiesin the State. She claims to have passed B.A. degree from a deemeduniversity, through correspondence course. The question as towhether degrees awarded by such universities are equivalent to thoseawarded by the regular universities was considered by this Court inW.P.No.22922 of 2006 and batch. It was held that unless suchdegrees are recognized by the regular universities, into whichadmission is sought in a higher course, or the UGC, in accordancewith the prescribed procedure, they cannot be treated as equivalent.
Therefore, the facts of the case are squarely covered by the saidjudgment.
Following the same, the Writ Petition is dismissed. There shallbe no order as to costs.
