ORDER:
The present criminal petition is liled under Section 482Cr.P.C. seeking to quash the proceedings in FIR No.567 of 2O2O onthe file of Aiwal police station, Cyberabad, registered for theoffences punishable under Sections 12O-B, 42O, 406 read with 34IPC.
2. The criminal petition is taken up for hearing today, i.e.30. 12.2O2O, through Video Conferencing.
3. Heard learned counsel for the petitioners and iearnedAdditional Public Prosecutor appearing for respondent State.
4. Learned Counsel for the petitioners would submit that thecomplaint lodged by the 2"d respondent/defacto-complainant ispurely a commercial business transaction relating to MOU enteredinto between the petitioners and the respondent No,2/defaco-complainant. Learned Counsel for the petitioners would furthersubmit that what is otherwise the civil dispute has been given acolour of criminal nature by lodging the present complaint.Learned Counsel for the petitioners would submit that the presentpetition is filed seeking quashing of FIR. However, after makinginitial submissions, learned counsel for the petitioners wouldsubmit that he is restricting the relief sought for in the presentcriminal petition to seeking a direction to the respondentauthorities for issuing notice under Section 41-A Cr.P.C. to thepetitioners herein and following the guidelines laid down by theHon'ble Apex Court in ARIVIESIT I(UIWAR V/s. STATD OF BIHARI.
