ORDER:
This Writ Petition, under Article 226 of the Constitution ofIndia, is filed by the petitioner seeking the following relief:
"to issue an order, writ or direction more particularly one in thenature of Writ of Mandamus declaring the action of therespondents 2 to 6 in trying to issue LRS proceedings inconnection with the [petitioners ]agricultural lands in Sy.Nos.188(Ac.1-02 %), Sy.No.190 (Ac. 1-07), Sy.No.192 (Ac.3-20), Sy.No.195, (Ac.1-33) Totaling Ac.7.00 gts, situated atGandicheruvu village, Abdulapurmet Mandal, Ranga ReddyDistrict, in favour of any third parties, basing on the fabricatedlayout issued by the 6ih respondent, in connection with thepetitioners agricultural lands, without considering therepresentation dated 26.02.2021, is highly illegal, arbitrary andagainst to the [principles ]oF natural [justice ]and also violative ofArticles 14, 19, 21 and 300A of Constitution of India, by settingaside the layout plan and consequently direct the respondents 2to 6 not to grant any LRS [proceedings ]in favour of any thirdparties without following due process of law."
2. Heard the learned counsel for both sides and [perused ]therecord
3. As per the pleadings and the submissions made on behalf ofthe petitioner, the petitioner is the owner and [possessor ]ofagricultural lands admeasuring Ac.1-02% [gts ]in Sy.No.188,admeasuring Ac.1-07 [gts ]in Sy.No.190, admeasuring Ac.3-20 [gts]in Sy.No.192, admeasuring Ac.1-33 gts in Sy.No.195, totallingAc.7-00 gts, situated at Gandicheruvu village, Abdullapurmetl,landal, Ranga Reddy District. Some land [grabbers ][in ]connivancewith the oFficial respondents are trying to [get ][LRS ][approval ][in]respect of the lands belonging to the [petitioner, ][by ][misrepresenting]the facts and using undue [influence ][etc., ][which ][is illegal, ][arbitrary]and ultimately, sought [a ][direction ][to ][set ][aside ][the ][layout ][plan ][and]
also to direct the respondent Nos.2 to 6 not to ,issue LRSproceedings in favour of third parties.
4. On the other hand, Sri Sampath Prabhakar Reddy, learnedStanding Counsel for GHMC would submit that now, LRS scheme isnot available. He further submitted that the petitioner has notmade the persons, who are making attempts to obtain the benefitof LRS scheme, as party respondents to this writ petition. Withoutthere being any details of persons intending to avail LRS scheme,this writ petition is not maintainable. tyoreover, since the petitioneris claiming title and lawful possession over the land in the aforesaidsurvey numbers, the same is required to be adjudicated by thecompetent Civil Court and ultimately, prayed this Court to dismissthe Writ Petition.
5. The petitioner filed a [photostat ]copy of document, dated21.L0.2020, which does not establish existence of layout in relationto the land in Survey Nos.192, 19S and 190. Moreover, therespondent No.6-Gra mpa nchayt has no authority to issue layouts.Further, the petitioner did not specifically state the persons whoare making Aftempts to avail the benefit under LRS scheme.Further, the LRS scheme is not in force as on today. The petitioner,under the guise of this Writ petition, is trying to setfle the disputeof title and possession, which cannot be advertecl to anddetermined in this writ petition filed under Article 226 of theConstitution of India. It is for the petitioner to invoke thejurisdiction of the Civil Court for the same, if he chooses to do so.
6. Under these circumstances, it is nOt appropriate tO grant any relief as sought for in this Writ petition. The Writ petition is devoidof merit and is liable to be dismissed,
