O R D E R:
This is an application filed by the Official Liquidator attached to this Court asLiquidator of the above named company in liquidation under Section 462 of theCompanies Act, 1956 read with Rule 306 and 9 of the Companies (Court) Rules,1959 seeking approval of the half-yearly account of the company in liquidation forthe period from 01.10.2008 to 31.03.2009. While stating that there was delay inreceiving the Accounting Certificate and making further verification with reference torecords of the company, the Official Liquidator further prayed to condone the delayin filing the half-yearly account.
I have heard Sri M.Anil Kumar, learned counsel for the Official Liquidator andperused the material placed along with the application including the auditors reportdated 26.02.2010 submitted by Sri P.S.N.Ravishanker & Associates (CharteredAccountants) as well as the affidavit of the Official Liquidator verifying the accountand the statement of account.
Having regard to the documents placed before this Court, and there being noaudit objections, I deem it appropriate to approve the half-yearly account submittedin respect of the company in liquidation by condoning the delay in filing the same.
Accordingly, the company application is ordered as prayed for. No costs.
