ORDER:
Petitioners claim to be the owners and [possessors ]of. Iand in an extent of Acs.6.0l guntas in Survey No. 238 [of]Macharla Village, Gattu Mandal, Mahabubnagar District. [[t ][is ][their]case that the 1st respondent issued notil-rcation under [Section ][4(1)]of the Land Acquisition Act (for short, ['the ]Act', on [20.06.2008]proposing to acquire a total extent of Acs. I12.12.5 for formation ofMuchonipalli Balancing Reservoir at Macharla [Villagc ][which]includes land of petitioners. Though their [father's ][name ][was]notified in the notification under Section a(1) of the Act [and]de r:laration under Section 6, no notice was [issued ][d ]uring [the]acquisition proceedings, points out the petitioners. [Tttcrcafter,]petitioncrs came to know that Award No. D2.5361 [2OO8, dated]27.O7.2OO} was passed in favour of Respondcnts [4 ][and ][5 ][in]rcspcct of the subject property. 3rd respondent dated O2.O9.2OO8. lmmediately, [petitioners ]filedAppeal under Section 5(5) of the Rights in Land and [Pattadar]Passbook Act before the Revenue Divisional Offrcer, Gadwal, whoby proceedings dated 27.O3.2O1O granted stotus [quo ]order inrespect of the subject property. Hence, this Writ Petition seeking adirection to thc 2"d respondent to refer the Award dated27 .O7 .2OO9 to a competent civil Court under Section 30 of the Act.
2Heard learned counsel for petitioners.

The averments of the writ aflidavit show that as soon aspetitioners came to know that Award was passed in respect of thesubject property in favour of Respondents 3 and 4, they hled. claimpetition before thc 2"d respondent and immediately after they werein the know of proceedings dated 02.O9.2OOa which mutated thenames of Respondents 4 and 5 in the revenue records, petitionersapproached thc Revcnuc Divisional Offrcer by way of Appealwherein order o[ stotus quo was granted in respect of total extentof Acs. 18.O3 guntas n'hich includes the lands of petitioners. lttherefore, clczrrlv shorvs that there is title dispute betweenpetitioners on the onc hand and Respondents 3 and 4 on theother.

4. In view of the above, this [Court ][is ][of ][the ][view ][that ][the]claim petition of [petitioners ][deserves reference ][under ][Section ][30 ][of]the Act to the competent [civil ][Court.]
