ORDER:
This petition is filed to withdraw O.S.No.1851 of 2013 from thefile of V Additional Senior Civil Judge, City Civil Court, Hyderabad andtransfer the same to II Additional Chief Judge, City Civil Court to betried along with O.S.No.600 of 2013.
2. First Petitioner herein is 2[nd] defendant in O.S.No.600 of2013 and plaintiff in O.S.No.1851 of 2013. According to her affidavitboth suits have to be tried together to avoid conflicting decisions.
3. Advocate for respondent represented that respondent has noobjection for transfer of the suit as prayed for. He submitted at presentO.S.No.1851 of 2013 is not pending before V Additional Senior CivilJudge, but it is pending before XVII Additional Senior Civil Judge, CityCivil Court, Hyderabad and respondent has no objection to withdrawthat suit to be tried along with suit filed by respondent pending asO.S.No.600 of 2013 before II Additional Chief Judge, City Civil Court,Hyderabad.
4. Considering the reasons stated in the affidavit and alsoconsidering the submission of advocate for respondent, O.S.No.1851of 2013 which was pending before V Additional Senior Civil Judge,City Civil Court, Hyderabad as on date of filing of this petition nowpending before XVII Additional Senior Civil Judge, City Civil Court,Hyderabad is withdrawn and transferred to II Additional Chief Judge,City Civil Court, Hyderabad to be tried along with O.S.No.600 of 2013.
5. Accordingly, the Transfer Miscellaneous Petition allowed. No costs. As a sequel, miscellaneous petitions, if any filed in this civilmiscellaneous petition, shall stand closed.
