ARBAPPL/80/2001 of MR.B.V.NARASIMHA REDDY Vs STATE OF AP REP.SC IRR.AND CAD AND ANOTHER on 23 April 2003

ORDER:-

This application has been filed by the applicant in A.A.No.80 of2001 to appoint a sole Arbitrator in place of Hon’ble Sri JusticeY.V.Narayana (Rtd.) since he is no more to adjudicate upon thedisputes between the parties.

This Court by an order dated 23-4-2003 appointed Sri JusticeY.V.Narayana (Rtd.) as sole Arbitrator for resolution of the disputebetween the parties inter se. It is now reported that Sri JusticeY.V.Narayana died recently. Para 3 of the affidavit filed in support ofthe instant application reads as hereunder:- “I submit that thereafter, both the parties have approachedthe learned sole Arbitrator for resolution of the disputebetween them. Though the sole Arbitrator has initiated thearbitration proceedings, he could not take up the same forhearing due to ill-health. Unfortunately, the sole ArbitratorHon’ble Sri Justice Y.V.Narayana (Retd) who died recently,in order to resolve the dispute between the parties. Unlessthis Hon’ble Court is pleased to appoint a new soleArbitrator in the place of the sole Arbitrator Hon’ble SriJustice Y.V.Narayana (Retd) who died recently, theapplicant will suffer grave and irreparable loss. Hence, thisapplication.”

Learned Government Pleader for Arbitration appearing forrespondents No.1 and 2 does not choose to oppose the application.

Accordingly, the application is ordered appointing Sri JusticeC.Y.Somayajulu, a retired Judge of this Court, as sole Arbitrator forresolution of the disputes between the parties inter se. He is at libertyto fix his own fee.
