HON’BLE SRI JUSTICE R. SUBHASH REDDYWRIT PETITION No.16109 of 2011ORDER:

This writ petition is filed by the petitioner, questioningthe order of the Registrar of Societies/District Registrar,Y.S.R. Kadapa District.

Petitioner is registered under the A.P.SocietiesRegistration Act, 2001. As per Section 9 of the said Act,every year, the society shall, within 15 days from the dateon which the General Body meeting is held, has to furnisha list to the Registrar of Societies, which shall contain thenames and addresses of the members of the ManagingCommittee and the officers entrusted with themanagement of the affairs of the Society. In this case, such list was furnished by the petitioner on 21.04.2011,but subsequently, by impugned order dated 04.06.2011,passed in Proceedings No.G1/Sec/596/2011, theRegistrar of Societies/District Registrar, YSR KadapaDistrict, has deleted the said list from the records andordered to continue the body which was governing prior to21.04.2011. The said order is suspended by this Court by way of interim order, dated 14.06.2011, and it continuedall along.

In this case, it is to be noticed that during thependency of the writ petition, the year for which the listwas filed, itself, was expired. In view of the expiry of therelevant year, no further orders need be passed in this writpetition and it has become infructuous. However, if thereis any dispute with regard to the management, it is openfor the parties to approach the competent Court to workout the remedies. It is further made clear that if anydispute with regard to management is already pendingbefore any Court/forum, the same is to be decided withoutreference to any of the findings recorded in the impugnedorder.

Subject to the above observations, the writ petition is disposed of. No costs.

As a sequel, WPMP.No.19317 of 2011 andWVMP.No.3558 of 2012 stand closed.
