2. This a [,peal ]is [filed ][questioning ][the ][order ][dated ][17 '12 ]['2O2O]inI.A.No.5Tof2C20ino.S,No.li0of2o2oonthefileofIXAdditionalDistrict Judge, [S ][rngareddy. ][The ][appellant herein ][is ][respondent]no.3/defendant [nc ][3.]

Respo rdents 1 to [3 herein ][instituted O'S' ][No' ][110 ][of ][2020 in]the court of [IX ][A ][lditional ][District ][Judge, ][Sangareddy ][prayrng ][to ][grant]preliminary decre : [declaring ][that ][plaintiffs ][are ][entitled ][1:o ][1/4d ][share]each and defend .nt [no. ][1 ][is ][entitled ][to ][1 ][/ ][4th ][share ][in ][respect ][of ][suit]schedule [propert: ]:s; [to ][appoint ][Advocate ][Commissioner ][and ][divide ][the]land and allot [1,4th ][share each ][to ][plaintiffs ][by ][passing ][a ][final ][decree']In the said suit, [plaintiffs filed ][I.A ][No ][57 ][of ][2O2O ][under ][Order ][XXXIX]Rules 1 and 2 of [CPC ][to ][grant ][ad-interim ][injunct'on ][restraining]respondents / defr ndants [from ][alienating, ][mortgaging ][or ][creating ][any]charge over the tr [etition ][schedule properties pending ][disposal ][of ][the main]suit. While iss ting [urgent ][notices ][returnable ][by ][\8 ]['1 ]['2021' the ][trial]court ordered Ir: ntenance [of status ][quo ][as ][on ][that ][date. ][The ][appellant]enteredhisapperranceandfiledcounteraffidavitinl.A'No.57of2o2o,

Acc,rdingtolearnedcounselforappellant,appellanthereinand another [r< ][spondent ][hled ][counter affidavits, ][whereas, ][other ][two]respondents ha,e not [filed their ][counter affidavits ][so ][far. ][The counter]aflrdavit filed b. appellant [rvas ][taken on ][record ][on ][2.8.2021., thereafter,]

I.A., underwent several adjournments [and ][on ][last ][hearing ][i.e., ][on]21.12.2021 it was adjourned to [21.7.2022.]

5. Learned counsel for appellant [submits ][that ][trial ][Court ][has]not assigned any reasons while ordering [status ][quo ][and ][on ][that ][ground]itself, the said order is not sustainable. [He ][further submits ][that ][in ][spite]of requesting the trial Court to [take ]up [Interlocutory Application ][and]pass final orders after considering submissions [of ][appellant, ][the ][trial]Court is adjourning the [matter from time ][to ][time ][on ][the ][ground that]other respondents have not [filed counter ][affidavits. ][According ][to ][learned]counsel for appellant, though, [the ][claim of ][plaintiffs ][is ][over ][land to ][an]extent of Ac.3.00, out of [which ][appellant ][herein ][is ][concerned ][with ][only]Ac. 1.00 of land and trial [Court ought to ][have ][considered ][the entitlement]of the plaintiffs to seek injunction order. [He ][further ][submits ][that ][on]account of injunction [order ]to [maintain ][status quo ][and ][continuing ][the]said status quo order, [grave ][prejudice ][is ][caused ][to ][the ][appellant ][herein.]

6. Since the trial Court is [ceased ][of the ][matter ][and ][appellant]herein has already filed [counter affidavit, ][we do ][not ][intend ][to ][express ][any]opinion on merits of the matter. [Suffice ][to ][direct the ][trial ][Court ][to]expedite the hearing. Accordingly, [the C.M.A. ][is ][disposed of ][directing ][the]trial Court to expedite the [hearing ][of I.A. ][No. ][57 of ][2O2O. As sufficient]time is already affbrded, it [is ][open ][for ][the other respondents ][to file ][their]respective counter affidavits, if [they ][so ][choose, ][before ][the next ][date ][of]hearing. Be that as it may, [even ][if ][other ][respondents ][do ][not ][fi1e ][their]counter affidavits, the trial [Court ][may ][consider ][the ][issue ][of ][further]continuation of status [quo ][order/ ][entitlement ][of plaintiff for ][injunction]taking into consideration the [counter affidavit ][filed ][by ][the ][appellant]herein and after due consideration [of the ][respective ][submissions, ][pass]in [I.A. ][No. ][57 of ][2O2O ][expeditiously preferably ][within]appropriate orders a period of six we€ <s from the date of receipt [of ][copy ][of ][this ][order. ][No]
