ORDER :

Heard Sri K.S. Murthy, learned counsel for the petitioner and Sri Thoom Srinivas, learned standing counsel for the Respondentsand on consent this Writ Petition is disposed of at the stage ofadmission.

Responding to the notification published in the newspaper on06-09-2010 calling for applications for awarding of retail outletdealership at Karveti Nagaram, Chittoor District, the petitioner submitted her application. The said dealership is reserved for peoplebelonging to S.C. community. The petitioner is an Adi Dravida, anotified scheduled caste. Her social status was also certified by acertificate dated 01-10-2010.

The petitioner has been granted community certificate, dated 03-06-1998 by the Mandal Revenue Officer, Karveti Nagaram certifying thatshe belongs to Adi Dravida community, which is a scheduled caste. However, the 2[nd] Respondent has rejected her application by meansof Letter Ref :KRO/JJ/RET, on the sole ground that the petitioner did not produce her caste certificate. Aggrieved by the same, the petitioner has filed this Writ Petition.

Learned counsel appearing for the petitioner submits that alongwith the application, the petitioner has in fact submitted the Certificatedated 01-10-2010, which is a sufficient proof of the social status of thepetitioner, therefore the respondents ought to have considered herapplication without rejecting the same.

From the certificates dated 01-10-2010 and 03-06-1998 it isevident that the petitioner belongs to the scheduled caste communityand her application could not have been rejected on technical ground of non-production of a certificate.

Having regard to the facts and circumstances, this Writ Petition isdisposed of directing the respondents to consider application of thepetitioner on the basis of the certificate dated 01-10-2010, produced byher, in accordance with law. In any event, the petitioner is alsopermitted to submit required certificate/certificates at least by the dateof interview which is said to be scheduled on 03-01-2011.

Accordingly, the Writ Petition is disposed of. There shall be noorder as to costs.
