WRIT PETITION No.35229 of 2013
The vehicle was seized by order dated 04.11.2013 on the allegation ofviolation of the provisions of A.P. Excise Act, 1968. However, a direction wasissued to the Station House Officer, Prohibition and Excise to release thevehicle subject to fulfilment of conditions mentioned therein.
Learned counsel for the petitioner submits that the petitioner is a dailywage labour and he cannot fulfil the conditions, since one of the conditions for release of the vehicle is to provide Fixed Deposit Receipt for the value of thevehicle.
Having regard to the facts of this case, the Writ Petition is disposed ofdirecting the petitioner to furnish a third party security to the satisfaction of theStation House Officer, Prohibition and Excise. The petitioner shall fulfil all otherconditions. On fulfilling such conditions, the vehicle in question shall bereleased in favour of the petitioner. There shall be no order as to costs.
Consequently, Miscellaneous Petitions, if any, pending in this writpetition shall stand closed.
