Learned counsel [for ][the ][petitioner ][submits that ][respondent ][No'4]has availed loan [t-rom ][the petitioner ][by ][mortgaging the ][secured ][asset']It may be mentioned [that ][respondent ][Nos.2 ][and ][3 ][had ][availed financial]assistance from [respondent ][No. ][l. ][For ][default ][in ][repayrnent ][of ][the]loan, respondent No. I [has ][initiated ][proceedings against ][respondent]Nos.2 and 3 under the Securitization [and ][Reconstruction ][of ][Financial]Assets and Enlorcement ol [Security ][Interest Act,2002 (briefly, ][the]SARFAESI Act l.rereinafter).

Be it stated that [the ][secured ][asset ][was sold ][by ][respondent ][Nos'2]and 3 to respondent No'4' [Aggrieved ][by ][the ][action ][under ][the]SARFAESI Act, [respondent ][No.4 ][has ][filed ][securitization application]before the Debts Recovery [Tribunal-I, ][Hyderabad ][(Tribunal) ][which]has been numbered as S.A.No.78 [of ][2021. ][In ][S'ANo'78 ][of ][2021,]Tribunal had passed an order [on ][03.09.2021 ][directing ][the parties ][to]nraintain stat s qln. Subsequently, [the ][said order was ][extended]subject to payment ol Rs.10 lakhs by [respondent ][No.4' ][However,]respondent No.4 has stated that she is not [in ][a ][position ][to ][pay]the aloresaid amount. In the above backdrop, [the ][Advocate-]Commissioner has issued notice dated [18.08.2021 ][for ][taking ][over]

physical po: session of the secured asset. Aggrieved, present writpetition has I een filed.

After rearing learned counsel for the petitione:, \\,e are of theview that pt t tioner can intervene in S.A.No.78 of 2021 filed byrespondent I o.4 before the Tribunal and present its crrse. lf thepetitioner filt s such interlocutorv application rvithin a period ol twoweeks from today, respondent No.1 shall not take firrther stepspursuant to n >tice of the Advocate-Commissioner dated i 8.08.2021 .till such tir 3 the interlocutory application of tl.rr: petitioner [is]considered b1 the Tribunal.
