JUDGMENT:- (per Hon’ble Sri Justice K.C. Bhanu)
This Criminal Appeal, under Section 374 (2) of the Code ofCriminal Procedure, 1973 (for short, "Cr.P.C."), is directed against--the judgment, dated 26072005, in Sessions Case No.345 of 2004on the file of the Sessions Judge, Warangal, whereunder andwhereby, appellant/accused No.1 was found guilty of the offencepunishable under Section 302 of the Indian Penal Code, 1860 (forshort, ‘IPC’), and accordingly, she was convicted and sentencedto undergo rigorous imprisonment for life and also to pay a fine of-Rs.500/ (Rupees five hundred only), in default to suffer simpleimprisonment for one month.
2. Heard both sides.
3. Learned counsel for the appellant/A1 stated that theappellant seeks permission to withdraw the appeal as he wasreleased from the prison in pursuance of the grant of specialremission to the life convicts in terms of G.O.Ms.No.28 Home(Prisons.C) Department, dated 25-01-2011 and in pursuance of thesaid G.O., the appellant/A1 was released from jail. The appellantdoes not want to prosecute the appeal. Since the appellant seekspermission to withdrawn the appeal, the appeal is liable to bedismissed as withdrawn as the appellant was already released interms of G.O.Ms.No.28 Home (Prisons.C) Department, dated 25-01-2011.
4. In view of the said submission, the Criminal Appeal isdismissed as withdrawn.
5. Miscellaneous Petitions pending, if any, in this CriminalAppeal shall stand closed.
