It is : r,rrther clairn of the appellants rhatMr.Md.Yousuf Khan submitted representation to therevenr-le authorities for conducting sr.rr\zey,demarcation and lixing of boundary stones in respect of the sLrbject property, but the sarrre wasnot considered. Inspite of availing the said remedy, appellantshave subrnLtted representation to the respondentauthoritics on 20.O3.2O23, for release of the landadrrreasnring Ac.24O0-OO gts. in Sy.No.7, situatcd at\4ansoor:rba:cl \1illage, Saroornagar Mandal, [Ra ][nga]Reddy District. The learned Single Judge [has]dismissed Vr'.P.No.22 I of 2Op4 along with the batchby way of cornmon order dated O1.O5.2O24, [i.nter]alia on the q:ouncl that the appellants were nevcr in possession of the subject [property and ][further ][held]that the question of transferring [the land ][to ][the]appellants without [possession ][and ][under ][alleged]mernorandurn of [gift ]deed [is ]. [baseless ][and ][further]observed that in W.P.No.26934 [of ][2018 ][and ][batch,]the learned Single Juclge [granted ][liberty ][to ][the]appellants to pursue [the ][Civil ][1aw ][remedy. ][But ][the]appellants without [pursuing ][the ][said ][remedy ][fi1ed]W P.No,221 of 2ll24 ancl batci'r. 4.1. Learned counsel for [the ][appellants ][contended]that the appellants [are ][iandless ][poor ][persons ][and]they are entitled to [release ][of ][the ][sr-rbject ][land ][as ][per]the gift settlement deed [executed ][by ][Mrs. ][Haneefa]

The above said order clearly rcveals that thelearned Single Judge while disposing ofW.P.No.26934 of 20 1B and batch, granted liberty tothe appeilants to avail the corrrmon [1aw ]remedy forestablishing their title. The said order has [become]hnal and binding upon the appellants. [The]appellants instead of availing the cornrnon lawremedy i.e., approaching the competent Civil Courtsubrnitted represcntation before the [revenLle]authorities on 20.O3.2023 for release of the land [to]an extent ol Ac.24OO-O0 [gts. ]in Sy.No.7 situated [at]Mansoorabad Village, Saroornagar Mandal, [Ranga]Reddy District and filed W.P.No.22 7 of 2024 seekingdirection to the respondent authorities to [release ][the]above said land. The learned Single Judge [while]dismissing the writ petition rightly observed [that ][the]donors/original owners of the [appellants ][we're ][never]in possession of the subject land and the [question ][of]transferring the said land to the [appellants ][without]
