WRIT APPEAL No.1670 of 2014

Judgment:(per Sri Sanjay Kumar,J)

The petitioner in W.P.No.15315 of 2014 is in appeal against theorder dated 24.11.2014 passed therein dismissing the case. Wehowever find no grounds to interfere with the order passed by thelearned Single Judge for the reasons stated hereunder.

Admittedly, the writ petitioner did not claim any interest in theGovernment land situated in Survey No.910/2 of Malkajgiri Village. Helays claim only to the land in Survey No.910/1 of the said village, which is admitted by the State functionaries to be patta land.

Sri A. Ravinder Reddy, learned counsel for the appellant-writpetitioner, however stated that as the writ petition was dismissed, therespondents may take steps to dispossess the appellant even beforeany delineation is carried out in terms of the order under appeal.

The learned Government Pleader for Revenue, however, submits that no steps would be taken for removal of encroachments inthe Government land until the survey is completed.

In the light of this statement, the apprehension of the appellant-writ petitioner stands redressed.

The Writ Appeal is accordingly closed.

Pending miscellaneous applications, if any, shall also standclosed. No order as to costs.
