WRIT PETITION NO.27914 OF 2005

The petitioners claim that they have purchased land in S.No272, situated atAdarshnagar, Ananthapur, in 1988. As there was some disputes between petitionersand third parties, they made an application to second respondent seekingcomprehensive survey duly paying requisite amount of Rs.100/-. Though suchapplication was made in January, 2004, no action was taken. Therefore, presentWrit Petition is filed.

Heard the learned counsel for the petitioners and the learned Assistant GovernmentPleader for Revenue (General).

The petitioners purchased the property in layout No.299/83 of Ananthapur, whichpre-supposes that the land in S.No.272 ceased to be agricultural land. Therefore, asper the provisions of A.P.Survey and Boundaries Act, 1923, second respondent orsurvey officer cannot resolve the boundary dispute. If so advised, the petitioner mayfile appropriate suit for declaration against those third parties who are raising disputeregarding boundaries of the layout. In this Writ Petition, no relief can be granted tothe petitioner.

The Writ Petition with the above observations is accordingly disposed of.
