ORDER:

Petitioners seeks a Writ of Mandamus to declare action of the respondent in summoningthem to the police station at the instance of the creditors of the first petitioner’s husband, threatening them to execute the promotes in the creditors and in interfering with theirpersonal life and liberty as illegal and arbitrary.

Learned counsel for the petitioners submits that the husband of the first petitioner tookcertain loans from certain persons but the same has not been repaid. Therefore, at the instance of the creditors of the husband of the first petitioner the respondent is pressurizingthe petitioners to execute the pronotes in favour of the creditors.

The second respondent, who is the son-in-law of the first petitioner, is also threatened andpressurized by the respondent though he is not due and payable any amounts to thecreditors.

Having regard to the facts and circumstances of the case, the respondent is directed not to interfere with the personal life and liberty of the petitionersand not to summon them to the police station without there being any report/complaintalleging that the petitioners have committed a cognizable offence.
