ORDER:
Heard both sides.
It appears, the Goods Carriage vehicle bearingregistration No.AP 12 V 1262, belonging to the petitioner, wasseized by the 2[nd]respondent- Motor Vehicles Inspector,Narasaraopeta, Guntur District, on 28.05.2009, under a check report,on the ground of certain irregularities mentioned in the said checkreport. It is the grievance of the petitioner that there are no suchirregularities and his request to release the vehicle has not beenconsidered.
In the facts and circumstances of the case, without expressingany opinion on merits, the respondents are directed to release theGoods Carriage vehicle bearing registration No. No.AP 12 V 1262, tothe petitioner, on condition of the petitioner depositing a sum ofRs.10,000/- (Rupees Ten Thousand only) and furnishing anundertaking that he will not alienate the vehicle or create any thirdparty interest over it and will not alter its nature, during the pendency ofenquiry. However, the amount so deposited by the petitioner shall besubject to further enquiry under the check report dated 28.05.2009.
With the above directions, the writ petition is disposed of. Noorder as to costs.
