ORDER:

The petitioner claims to have been appointed as an Associate Professor inElectrical and Electronics Engineering, on ad hoc basis, in Sri VenkateswaraEngineering College, Suryapet, 3[rd] respondent herein, on 08.09.2003. He feelsaggrieved by the order, dated 25.05.2005, passed by the 3[rd] respondent, discontinuing him from service. It is alleged that the 3[rd] respondent did notfollow the procedure prescribed under the Andhra Pradesh Education Act, 1982(for short ‘the Act’).

Heard the learned counsel for the petitioner and the learned GovernmentPleader for Technical Education.

Admittedly, the 3[rd] respondent-College is a Private Un-aided Institution. By nostretch of imagination, it can be brought under the purview of the definition of“State” under Article 12 of the Constitution of India. Even assuming that there isany infraction of the procedure prescribed under the Act, the petitioner has toavail the remedies prescribed therein.

Therefore, the Writ Petition is dismissed, leaving it open to the petitioner towork out his remedies, in accordance with law. There shall be no order as tocosts.
