Crl.R.C.No.3289 of 2015
The present criminal revision case is directed against thedocket order dated 07.12.2015 passed in C.F.R.No.9321 of 2015 inCr.No.426 of 2015 by the learned Special Mobile Magistrate,Guntur.
2. The petitioner/A3, who is the owner of the vehicle i.e., Lorrybearing No.AP 27 W 5648, filed the impugned application seekingto return the said vehicle to him. By the order impugned, the trialCourt passed the following order; “How the petition is maintainable in view ofSection 6-E of Essential Commodities Act, 1955.
Challenging the same, the petitioner filed the present revision.
3. Heard and perused the material on record.
4. Since the impugned application was returned on the groundof maintainability, the petitioner has to give a reply informing theCourt about the maintainability of the said application. Withoutgiving such a reply, the petitioner approached this Court. In viewof the same, if any reply filed by the petitioner explaining themaintainability of the application, the learned Magistrate is atliberty to pass appropriate orders, and if there is any grievanceagainst such an order, the petitioner is at liberty to approach theappropriate forum in accordance with law.
5. Accordingly, the Criminal Revision Case is disposed of.Miscellaneous petitions, if any, pending in this revision shall standclosed.
