WRIT PETITION None on 18 December 2003

24-02-2021 ct no. 13 Sl.3

pk

WPCRC 17175 of 2003 (Through Video Conference)

Manoranjan Chakrkaborty

Versus

Sri Subimal Samanta and others

Mr. Ashim Kumar Routh

…for the petitioner

The writ petitioner seeks to move thiscontempt application filed in the year 2003. Itappears from the order sheet that the matterhas earlier been moved on 18.12.2003 and03.03.2004.

The petitioner does not appear to havetaken any step to get the matter listed or seekany remedies in respect of the order dated 27[th]September, 2002, after March, 2004.

It is submitted by counsel for thepetitioner that he has not received any salaryor allowances from the Bank for about 19 yearsnow.

It is difficult for this Court to believe thatthe petitioner has been working without salaryfor 17 years continuously. It is equally difficultfor this Court to entertain the contemptapplication after 18 years of inaction on thepart of the petitioner.

In those circumstances, WPCRC 17175 of2003 shall stand dismissed.

In view of dismissal of the contemptapplication, connected application, if any, alsostands dismissed.

The remedies, if any, available in law tothe petitioner either in respect of the orderdated 27[th] September, 2002 or otherwise, maybe agitated in appropriate proceedings inaccordance with law.

No order as to costs.

All parties are directed to act on a servercopy of this order on usual undertakings.
